Terms of Service

1. Acceptance of Terms

By accessing or using the FineCoreAI SaaS platform, creating an account, or interacting with your workspace inside FineCoreAI, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access the service.

2. Description of Service

FineCoreAI is a SaaS (Software as a Service) platform that allows businesses to upload their proprietary data (such as PDFs, CSVs, and chat logs like WhatsApp exports) to index, manage, and use custom AI agents powered by retrieval-augmented generation (RAG) directly inside the platform.

3. Subscriptions and Billing

We offer tiered subscription plans (e.g., Starter at $0/mo (originally $19/mo), Pro at $49/mo, and Business at $99/mo):

• Token Limits: Each tier has a daily token generation limit (e.g., 10k, 100k, or 1M tokens/day). Exceeding these limits may result in temporary usage throttling until the next billing cycle.
• Model Limits: The number of active custom models is restricted by your subscription tier.
• All payments are non-refundable unless otherwise required by law.

4. User Data and Responsibilities

You retain all rights and ownership to the business data you upload. However, you agree to the following conditions:

• You must have the legal right and necessary permissions to upload and process the data.
• You will not upload sensitive, illegal, malicious, or highly regulated personal data without proper compliance frameworks.
• You are responsible for any actions taken through your customized agents and workspace usage.

5. Platform Restrictions

You agree not to reverse engineer, decompile, or attempt to extract the source code of FineCoreAI's platform. Scraping, abusing, or attempting to breach the tenant isolation (Supabase RLS) is strictly prohibited and will result in immediate account termination.

6. Acceptable Use Policy

You agree NOT to upload, store, or process any content that:

• Infringes on any third-party copyright, trademark, patent, or other intellectual property right.
• Contains illegal, defamatory, fraudulent, or otherwise unlawful material.
• Contains malware, viruses, or any code intended to disrupt the platform.

Violation of this policy may result in immediate removal of content and account termination without prior notice.

7. Copyright Infringement & DMCA Notice

FineCoreAI respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond expeditiously to notices of alleged copyright infringement.

If you believe that material available on FineCoreAI infringes your copyright, please submit a notice through our abuse reporting page with the following information:

• Your physical or electronic signature.
• Identification of the copyrighted work claimed to be infringed.
• Identification of the material that is infringing, with enough detail for us to locate it (e.g., agent slug, file name, upload date).
• Your name, address, telephone number, and email address.
• A statement that you have a good faith belief that the use is not authorized by the copyright owner.
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

Upon receipt of a valid DMCA notice, we will remove or disable access to the allegedly infringing material and notify the affected user. False or misleading DMCA notices may result in legal liability.

8. Repeat Infringer Policy

FineCoreAI maintains a policy of terminating the accounts of users who are determined to be repeat infringers of copyright. A "repeat infringer" is any user who has been the subject of more than one valid DMCA takedown notice. We reserve the right to terminate accounts at our discretion based on the severity or frequency of violations.

9. Indemnification

You agree to indemnify, defend, and hold harmless FineCoreAI, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your uploaded content or data; (b) your violation of these Terms; (c) your violation of any third-party right, including any copyright or intellectual property right; or (d) any claim that your content caused damage to a third party.

10. Limitation of Liability

FineCoreAI is provided "as is" and "as available". We do not guarantee uninterrupted, error-free operations. In no event shall FineCoreAI be liable for any indirect, incidental, special, or consequential damages arising from the use of our generated models or platform features.
